• The Basic Trust Package works best for someone who has created a trust in the past and needs to update, amend, or restate it.  The Basic Trust Package may also work for someone creating their first living trust if you are:

  • Not a blended family;

  • Do not want creditor protection for your beneficiaries;

  • Do not want protection from nursing home expenses;

  • Do not want tax savings; and

  • Planning to leave everything to your spouse (if married), then children equally.

• The documents you prepare in this Package will avoid probate during life and after death if you follow through with all instructions regarding the funding of your trust.  If you do not follow through, your family may still be required to go through probate.  Typical costs for an uncontested probate are $25,000 during life and $10,000 after death.

• Two Appointments:  You get one-on-one help with this Service Package at two appointments with our team.  At these appointments, you will accomplish the following.

  • First Appointment:  This appointment is a Design Appointment with one of our qualified estate planning attorneys where you can ask any questions you want.  You will get legal advice about any issues relating to the documents that will be created for you.  You will get answers to questions about who should be your trustee, who should be your power of attorney, and who can serve as your healthcare agent, among other things.

  • Second Appointment:  This appointment is a Signing Appointment with our estate planning team members.  At this appointment, you will review the portions of the documents that were customized based on the decisions you made at your Design Appointment and you will sign your legal documents.  Our team will review your customized portions - in detail - with you.  The other provisions of the documents (the “boilerplate”) are not reviewed in great detail because those do not typically change from client to client.  After you sign, our team will witness and notarize the documents.  They are valid immediately. Our team will show you how to fund your trust.  Your homework after this appointment is to fund your trust.  We will then scan an electronic version into our database for safekeeping and the originals will be ready for pick up within two weeks.
