The Premium Trust Package works best for someone who is creating their first living trust and does not have the time or desire to fight the bureaucracy of financial institutions. Every trust needs to be “funded” with all bank accounts, insurance, real estate, investments, vehicles, annuities, retirement accounts, etc., etc. If you don’t want to figure out that process, this package is for you. This Package has worked very well for clients who are:
Busy with work, business, family, or travel;
Appreciate seeing someone do the work for them so they can do it themselves later; and
Want to ensure everything is done correctly by a professional.
The documents you prepare in this Package will avoid probate during life and after death because we are going to do the first round of funding of your trust. The budget (limit) is 10 items funded under this package meaning you will have 100% peace of mind that these 10 will not go through probate. If you have more than 10 items, you can either do the rest yourself (if you paid attention and watched what we did on the first 10), or you can have our team do the rest of the items a la carte. Because remember, anything left out of your trust can likely end up in a lifetime or after-death probate. Typical costs for an uncontested probate are $25,000 during life and $10,000 after death.
Seven Appointments: You get one-on-one help with this Service Package at seven appointments with our team. At these appointments, you will accomplish the following.
Design Appointment: This appointment is a Design Appointment with one of our qualified estate planning attorneys where you can ask any questions you want. You will get legal advice about any issues relating to the documents that will be created for you. You will get answers to questions about who should be your trustee, who should be your power of attorney, and who can serve as your healthcare agent, among other things.
Drafts Appointment: This appointment is for you to review the portions of your estate plan that were customized for you. NOTE: You will review a Summary of the documents, not the hundreds of pages of the final documents. We do not ask our clients to review and approve the necessary and critical boilerplate of the documents that we have crafted over the decades of our experience. We only ask you to review and approve the portions of the documents that are customized for your particular situation.
Signing Appointment: This appointment is a Signing Appointment with our estate planning team members. At this appointment, you will again review the portions of the documents that were customized based on the decisions you made at your Design Appointment. If those portions look correct, you will sign your legal documents. After you sign, our team will witness and notarize the documents, including the deed for your house if needed. All documents are valid immediately. Our team will also show you how to fund your trust and how to use your Certificate of Trust. Your homework after this appointment is to fund your trust. We will then scan an electronic version into our database for safekeeping and the originals will be prepared for pick up at your final appointment. Our estate planning team will also work with you to create a comprehensive list of everything that needs to be funded to your trust. This is called the Trustee Asset Report. Each item on the list will also have specific instructions about how it will be funded to your trust and which items constitute the 10 you want us to fund.
Delivery Appointment: At this appointment, we will deliver to you the final, signed original estate planning documents. We will advise you how to store these so that they are accessible in an emergency. We will also teach you additional information about funding your trust. And, you will record your first Legacy Interview for your loved ones.
Funding Round 1 Appointment: Your first round of funding documents are ready for signature. These will be instructions, letters, forms, and/or deeds funding various items into your trust. Each funding document will need various attachments (portions of your trust) that our team will organize, collate, and mail to each necessary institution. We will track these documents through the mail.
YOUR TASK: Check your mail & email for anything that each of these institutions send back to you. Gather whatever information they provide into one packet and bring back to us 2 weeks before your next appointment. Do not provide these to us piecemeal. They will send you either a 1) confirmation, 2) rejection with instructions to fix, or 3) request for further information. No matter what it is, bring it to us. You don’t need to try to figure it out on your own.
Funding Round 2 Appointment: We will update your Trustee Asset Report with the current status (Funded or Pending) and draft any “2nd Round” instructions necessary to fund the remaining 10 items. You will sign these instructions at this appointment, we will prepare the correct attachments from your trust documents, mail them out, and track them.
YOUR TASK: Check your mail & email for anything that each of these institutions send back to you. Gather whatever information they provide into one packet and bring back to us 2 weeks before your next appointment. Do not provide these to us piecemeal. Funding Round 3 Appointment: We will update your Trustee Asset Report with the current status (Funded or Pending) and draft any “3rd Round” instructions necessary to fund the remaining 10 items. You will sign these final instructions at this appointment, we will prepare the correct attachments from your trust documents, and mail them out.
YOUR TASK: Check your mail & email for anything that each of these institutions send back to you. Gather whatever information they provide into one packet. At this point, all 10 items should be funded correctly. If any items remain Pending, please call our office.
