Arizona’s Proof of Authority process is a vital step in certain probate cases that are active outside of Arizona to manage the portion of a decedent’s estate that is inside Arizona. Our Proof of Authority Service is designed to assist clients in navigating this process efficiently, ensuring they have the documentation required to fulfill their duties.

What is Proof of Authority?

In Arizona probate proceedings, the court may require a personal representative (executor) to present a formal Proof of Authority document to transfer real estate from the decedent to the heirs. This document serves as evidence that the court has officially appointed them to administer the estate, granting them the legal ability to sign a deed to the rightful heirs.

How Our Service Works

1. Case Evaluation:

   • Must have an active probate in another state.

   • Must have a personal representative/executor already appointed in that other state.

2. Document Preparation:

   • We prepare the necessary forms and documentation, ensuring they meet the legal standards required by Arizona probate courts.

3. Court Filing Guidance:

   • We conduct the entire filing process, ensuring the documents are properly submitted to the appropriate court.

   • We obtain the necessary documents that need to be recorded for the transfer to heirs.

• Court Fees: Filing fees and related costs are separate and depend on the court’s requirements.

• Eligibility: Proof of Authority is typically issued as part of formal or informal probate proceedings that are active in another state.

• Property: Only one piece of real estate is included in this price. Each additional property is $750 each.

• Grantees: This price includes up to three heirs (grantees) who will receive the property. $100 additional for each extra grantee.
